Important Disclaimer of Liability
BidMotors is exclusively a venue and technology platform. We are not an auctioneer, we do not own the vehicles listed, and we do not act as an agent for the Buyer or the Seller. We take absolutely no responsibility for the condition of any vehicle, the accuracy of any listing, verifying seller ownership, or the successful completion of any transaction. By using BidMotors, you agree that you participate entirely at your own risk.
1. Acceptance of Terms
By registering an account and accessing the BidMotors platform ("the Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our platform. These Terms may be updated at any time, and continued use constitutes acceptance of those variations.
2. Nature of the Platform
BidMotors provides a digital marketplace connecting independent Buyers and Sellers in New Zealand.
- We are not a party to any contract or agreement formed between Buyers and Sellers.
- We do not inspect, test drive, or verify the mechanical soundness, odometer reading, or legal title of any vehicles listed.
- We do not guarantee that a Seller will validly complete a sale, or that a Buyer will pay for an item won at auction.
3. New Zealand Consumer Laws
Consumer Guarantees Act 1993 (CGA): The CGA outlines statutory guarantees for goods purchased from people "in trade". If you purchase a vehicle from a private seller on BidMotors, the guarantees under the CGA do not apply. You purchase the vehicle "as is, where is". If the Seller is a registered motor vehicle trader, the CGA may apply to your purchase directly between you and the Seller.
Fair Trading Act 1986 (FTA): Sellers who are "in trade" must not engage in misleading or deceptive conduct. BidMotors relies on the accuracy of the information provided by Sellers and assumes no liability for fraudulent or misleading vehicle descriptions.
Motor Vehicle Sales Act 2003 (MVSA): It is the obligation of any Seller who is a Motor Vehicle Trader to disclose consumer information notices (CIN) as required by law. BidMotors holds no liability for a Seller's failure to provide a CIN.
4. Bidding & Buying
All bids placed on BidMotors are considered legally binding offers to purchase the vehicle. If you hold the highest bid at the close of an auction and the reserve price has been met (or the auction is unreserved), you are legally obligated to complete the purchase directly with the Seller. Bid retraction is only permitted in exceptional circumstances solely determined by BidMotors.
5. Seller Obligations
Sellers must accurately describe the vehicle's condition, history, and status (e.g., imported, previously written off, finance owing). Sellers must ensure they have the legal right to sell and transfer ownership of the vehicle free of any security interest (unless explicitly stated otherwise). Fees paid to list an auction on BidMotors are non-refundable once the auction goes live, regardless of whether the vehicle sells.
6. Payment & Escrow
BidMotors uses third-party payment gateways (such as Stripe) to process listing fees and platform success fees. We do not act as an escrow service or payment processor for the actual vehicle purchase price between the Buyer and Seller. The final transfer of funds for a vehicle happens entirely off-platform, at the risk of the interacting parties.
7. Indemnity
You agree to indemnify and hold BidMotors, its directors, employees, and agents harmless from any claims, damages, liabilities, costs, or expenses (including legal fees) arising directly or indirectly from your use of the Platform, your breach of these Terms, or your violation of any laws or rights of third parties during a transaction initiated on BidMotors.
